Arcannia Terms of Use
1. Acceptance of Terms
By creating an account, accessing, or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms of Use (“Terms”). If you do not agree, do not use the Service.
2. Definitions
- “Arcannia,” “we,” “us,” or “our” means the operator of the Service (legal entity: , CNPJ: , address: ).
- “Service” means the Arcannia platform, websites, apps, APIs, and related services.
- “Humanari” or “humanari_” means AI-powered software agents made available through the Service.
- “Digital Representation” means a Humanari (or “humanari_”) made available through the Service, and any other AI-powered agent that Arcannia explicitly designates as a Digital Representation. For clarity, the use of a trailing underscore character (“_”) in a name (e.g., “Jesus_”) designates such a Digital Representation and does not refer to, nor shall it be construed as, the natural person or legal entity bearing the same name.
- “Input” means any content you submit, upload, transmit, or otherwise provide to the Service.
- “Output” means any content generated by the Service or Humanari.
- “Content” means Input, Output, and any other text, audio, images, files, or data made available through the Service.
3. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. If you are not, you may use the Service only with the involvement and consent of a parent or legal guardian, who agrees to be bound by these Terms.
4. Service Description
Arcannia provides access to Humanari—AI-powered software agents designed to mirror aspects of human conversation and to simulate certain styles such as memory-like context, personality-like patterns, emotional tone, and (where available) voice interaction.
Humanari are software tools. They are not human, not conscious, not sentient, and do not provide professional services. The Service does not create any fiduciary, therapeutic, medical, legal, or other professional relationship.
5. Nature and Limitations of AI Outputs
You acknowledge and agree that:
- Output may be incorrect, incomplete, misleading, outdated, or otherwise unreliable.
- Humanari may behave in unexpected ways and may generate content that you find inaccurate, inappropriate, or offensive.
- You are responsible for evaluating Output for accuracy, safety, and suitability for your intended use, including human review where appropriate.
- You must not rely on Output as a sole source of truth or as a substitute for professional advice.
6. Output Use and Responsibility
Subject to your compliance with these Terms, you may use Output for lawful purposes.
You acknowledge that Output may not be unique and that similar or identical Output may be generated for other users. Arcannia makes no representations regarding intellectual property rights in Output and disclaims any liability for your use of Output.
You are solely responsible for ensuring your use of Output does not violate any law or third-party rights.
7. Simulated Characters and References to People
For clarity, any name displayed with a trailing underscore (“_”) denotes a Digital Representation (as defined in Section 2).
Some Humanari may be presented as, or may reference, styles inspired by well-known historical figures, public figures, or fictional characters. Such Humanari are:
- Fictionalized simulations for commentary, education, and demonstration of technology;
- Not endorsements, approvals, or official representations;
- Not affiliated with, sponsored by, or authorized by any individual, estate, rights-holder, or related party unless explicitly stated in writing by Arcannia.
Nothing in the Service should be interpreted as claiming that any Humanari is the real person represented.
If you are a rights-holder (or authorized agent) and believe content on the Service infringes rights, contact us at with sufficient details for review. We may remove, modify, or restrict content at our discretion.
8. Service Availability, Beta Features, and Changes
You acknowledge that:
- The Service (or any feature) may be modified, updated, suspended, or discontinued at any time.
- Some features may be experimental or provided for evaluation (“Beta Features”).
- Voice interactions may be unavailable, limited, or intermittently disabled because voice features may remain under active development and testing.
- Availability is not guaranteed; interruptions may occur due to maintenance, upgrades, outages, or other reasons.
9. User Responsibilities
You agree to:
- Use the Service only for lawful purposes and in accordance with these Terms.
- Provide accurate account information and maintain the security of your credentials.
- Independently verify Output before using it for decisions with material impact (including medical, legal, financial, safety, or professional decisions).
- Ensure you have all necessary rights, permissions, and consents for any Input you provide, including any voice, likeness, personal data, or third-party content.
10. Prohibited Uses
You may not use the Service to:
- Generate or facilitate harmful, illegal, or malicious activity;
- Harass, threaten, defame, or abuse others;
- Infringe intellectual property, privacy, publicity, or other rights;
- Impersonate another person or misrepresent the origin of content;
- Create or distribute deceptive content intended to mislead others (including unauthorized voice cloning or deepfakes);
- Attempt to bypass security controls, access restricted areas, or interfere with the Service’s operation;
- Reverse engineer, extract, or attempt to discover underlying models, systems, or architecture except to the extent permitted by law.
11. Intellectual Property
The Service and all related technology, architecture, software, models, designs, and proprietary content are owned by Arcannia or its licensors and are protected by applicable laws. Subject to your compliance with these Terms, Arcannia grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal or internal business purposes.
No rights are granted except as expressly stated in these Terms.
12. User Content and License
You retain ownership of your Input, subject to any rights of third parties. You grant Arcannia a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, transmit, and use your Input solely as necessary to:
- Provide and operate the Service;
- Maintain safety, security, and integrity;
- Improve and develop the Service (including debugging, analytics, and quality improvement), subject to Section 13 (Privacy and Data) and applicable law.
13. Privacy and Data
We do not currently publish a separate Privacy Policy. This Section 13 describes how we handle data in connection with the Service.
You should avoid sharing sensitive, confidential, or personal information unless necessary. You are responsible for what you submit to the Service.
We may collect and process Input, Output, account information, device/usage data, and related metadata solely to operate, secure, maintain, and improve the Service, and to comply with applicable law. We may use service providers (sub-processors) to support these activities, and data may be processed or stored in Brazil or other countries.

We may publish and update a separate Privacy Policy in the future. If we do, it will apply from its effective date forward and will govern how we process personal data, to the extent required by applicable law.
14. Third-Party Services
The Service may integrate with or link to third-party services. Arcannia is not responsible for third-party content, products, services, availability, or practices. Your use of third-party services is governed by their terms and policies.
15. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.
WITHOUT LIMITING THE FOREGOING, Arcannia DOES NOT WARRANT THAT:
- The Service will be uninterrupted, error-free, or secure;
- Output will be accurate, complete, reliable, or up to date;
- Defects or errors will be corrected.
16. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, Arcannia SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO:
- Your access to or use of (or inability to access or use) the Service;
- Any Output (including inaccuracies, errors, or omissions);
- Unauthorized access to or alteration of your data;
- Any third-party content or services.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, Arcannia’s TOTAL LIABILITY FOR ALL CLAIMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO Arcannia FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is not permitted by applicable law.
17. Indemnification
You agree to indemnify, defend, and hold harmless Arcannia and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to:
- Your use of the Service;
- Your Input, including any allegation that Input infringes or violates third-party rights;
- Your violation of these Terms or applicable law;
- Your misuse of Output, including redistribution or reliance by third parties.
18. Account Suspension and Termination
Arcannia may suspend or terminate your account (and restrict access to the Service) at any time, with or without notice, if we reasonably believe you have violated these Terms, engaged in fraud or illegal activity, or misused the Service. You may terminate your account at any time by sending an email to .
19. Modifications to Terms
We may update these Terms from time to time. Unless otherwise required by applicable law, we are not obligated to provide advance notice of changes. The “Last Updated” date at the top of these Terms indicates when they were most recently revised.
If we choose to provide notice of material changes, we may do so by posting an in-Service notice or by email to the address associated with your account. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
20. Dispute Resolution
Before filing any claim, the parties may attempt to resolve the dispute through informal discussions. If you wish to do so, you may contact us at with a brief written description of the dispute and the relief requested. If the dispute is not resolved, either party may pursue claims in accordance with Section 21 (Governing Law and Jurisdiction).
21. Governing Law and Jurisdiction
These Terms are governed by the laws of Brazil, without regard to conflict of law principles. Unless a different dispute resolution mechanism is specified in Section 20, any disputes shall be resolved exclusively in the courts located in Santiago, RS, Brazil. Notwithstanding the foregoing, if you qualify as a consumer under applicable law, you may bring claims in the forum required by mandatory consumer protection rules.
22. Severability
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
23. Entire Agreement
These Terms, together with Section 13 (Privacy and Data) and any Privacy Policy we may publish in the future, constitute the entire agreement between you and Arcannia regarding the Service and supersede all prior agreements or understandings.
